Terms and Conditions

1. Definitions

  1. In these General Terms and Conditions "VicoVida" refers to the private limited liability company, registered with the Chamber of Commerce with number 84105323, with primary establishment at Flight Forum 40 (5657DB) in Eindhoven;
  2. In these general terms and conditions, "Customer" refers to any natural person or legal entity that has entered into an agreement with VicoVida via the website or otherwise wishes to enter into an agreement, as well as his/her (authorised) representative(s) and legal successor(s);


2. Applicability

  1. These general terms and conditions apply to the use of the website.
  2. By using the website, the user agrees to these general terms and conditions.
  3. Use of the VicoVida platform is subject to these Terms of Use, Privacy Policy, Cookie Policy and other additional regulatory documents published by VicoVida on the VicoVida platform. 
  4. If you do not agree with the contents of these documents, you should not use VicoVida. 
  5. VicoVida reserves the right to unilaterally modify these Terms of Use without prior notice. Modifications will take effect immediately, unless otherwise stated. The announcement will be made by publication on the VicoVida platform and/or sending a notice by email to all VicoVida account holders. You irrevocably accept these changes when you continue to use the VicoVida platform after the changes. We advise you to consult these Terms of Use regularly. 
  6. These Terms of Use apply to all agreements, all offers and all VicoVida products and services unless otherwise specified. Deviations from these Terms of Use are only valid if expressly agreed with you in writing.
  7. Your rights and obligations: as a user of the VicoVida platform, you must act and behave in all respects as may be expected of a responsible and careful Internet user. 
  8. Among other things, you are not allowed to use (the content of) the VicoVida platform for acts and/or conduct contrary to the law, public order or morality. More specifically, the following acts and/or conduct are not permitted: 

a. infringe or otherwise act contrary to intellectual property rights of VicoVida and/or third parties; 

b. making infringing, unlawful or misleading announcements; 

c. disseminate legally prohibited material;

d. circumvent, evade or remove the security of (parts of) the VicoVida platform.


3. Offers / Tenders of Agreement

  1. All offers by VicoVida should be regarded as an invitation to potential Customers to make an offer. Offers are therefore without obligation and do not bind VicoVida. If a fixed offer is made, it shall be valid for the period stated in the offer. If the period of validity is not specified, the offer shall in any case expire after four weeks.
  2. An agreement only comes into effect when VicoVida confirms the Customer's order in writing (including e-mail).
  3. Agreements are always concluded under the condition that, in VicoVida's opinion, information obtained by VicoVida shows sufficient creditworthiness of the Customer.
  4. The Customer guarantees that the application or order information it provides to VicoVida is correct and complete.
  5. Collection and Use of Personal data
  6. The Privacy Policy tells you what VicoVida uses the personal data collected about you through the VicoVida platform and how you can exercise your rights in relation to this data. You can find more information about the cookies used by VicoVida on the Privacy Policy page.    
  7. The website acts in accordance with applicable data protection and privacy legislation.


5. Force Majeure

  1. 'Force majeure' shall include (but not be limited to) the situation in which VicoVida is affected by extraordinary circumstances, such as restrictive government measures of any kind, mobilisation, war, revolution, traffic impediments, breakdowns in a (telecommunications) network or connection or communication systems used and/or the unavailability of the website or transport problems at any time and all circumstances which VicoVida could not foresee or over which it has no control or which are beyond VicoVida's reasonable control.
  2. If fulfilment by VicoVida of one or more of its obligations cannot reasonably be required due to one or more of the circumstances listed above, it shall not be liable for non-performance and shall be entitled to terminate the contract (in whole or in part) without being liable for any compensation.

6. Accountability and complaints

  1. The website strives to provide accurate and up-to-date information, but does not guarantee the accuracy, completeness or timeliness of the housing offers or other information on the website.
  2. The website shall not be liable for any damages, direct or indirect, arising from the use of the website or its contents.


7. Intellectual property

  1. All content on the website, including texts, images and logos, are the property of the website or its licensors and are protected by copyright and other intellectual property rights.
  2. Users may not copy, reproduce, distribute or use the content of the website for commercial purposes without written permission.


8. Changes and termination

  1. The website reserves the right to modify these terms and conditions at any time without prior notice.
  2. The website may suspend or terminate access to the website without giving any reason.


9. Applicable laws and competent court

  1. Dutch law shall apply to all offers, agreements, deliveries and services made or issued, entered into, performed or executed by or on behalf of VicoVida.
  2. All disputes that may arise as a result of or in connection with an agreement shall be submitted to the competent judges of the court in 's-Hertogenbosch.
  3. Unless otherwise provided in these terms and conditions, English words in these terms and conditions are intended to describe Dutch legal concepts only and the consequences of the use of those words in English law or any other foreign law are disregarded. References to any Dutch legal term shall, in respect of any jurisdiction other than the Netherlands, be deemed to include the term which in that jurisdiction most closely approximates the Dutch legal term.


10. Statement of agreement

By using the website, the user agrees to these terms and conditions. It is advisable to check these terms and conditions regularly for updates.
